The 500-Hour Residential Drug Abuse Program, Reduce your prison sentence with RDAP

The 500-Hour Residential Drug Abuse Program, also known as RDAP, is a highly specialized program offered by the Bureau of Prisons. This is a Bureau of Prisons’ program which is of great benefit to inmates with a substance abuse problem whether it is illegal drugs, abused prescription drugs, or alcohol. You may be eligible if you've used alcohol, illegal drugs (marijuana, cocaine, etc.), or abused legal prescription drugs such as Oxycontin, Percodan, Percocet, Xanax, Ambien, etc. We are experts at positioning our clients for this program and using collateral documentation as identified in the March 2009 revision of PS 5331.02, Early Release Procedures Under 18 U.S.C. § 3621(e). As an incentive for successfully taking and completing the program, the inmate may receive up to twelve (12) months off his sentence and up to six (6) months of halfway house confinement, depending upon his initial length of sentence. The final six months of the inmate’s sentence is spent in a halfway house rather than serving this time in prison. The net effect is to reduce the defendant’s institutional sentence by up to eighteen (18) months! Imagine eighteen (18) months less of institutional confinement. This is also in addition to any good conduct time earned.

Eligibility for the 500-Hour Residential Drug Abuse Program is determined by a variety of factors. The Pre-Sentencing Investigation Report (PSI) is one of the factors used to determine eligibility. Other factors, just as important, are the Residential Treatment Eligibility Interview (RTEI Report) and the RDAP Eligibility Assessment & Positioning Paper (REAPP) provided by Jail Time Consulting to every client. These valuable reports help to position the client for eligibility and acceptance into the RDAP Program. A recommendation by the sentencing judge, although useful, does no longer guarantee admission to the RDAP program. Besides, the BOP is not required to follow or implement the judge's recommendation for the RDAP program. The defendant must have a thorough knowledge of the March 2009 program revisions to Program Statement P5331.02. The inmate must meet the diagnostic criteria for substance abuse or dependence indicated in the Diagnostic and Statistical Manual of the Mental Disorders, Fourth Edition, (DSM-IV). In addition, in the March of 2009 revisions, the BOP instituted significant changes to the RDAP program in both eligibility requirements and incentives. There is specific documentation that the BOP is looking for and is included in their 2009 Program Statement revision.
